How do I know when I need to declare bankruptcy and which type I should file?

In our economic times, many people are facing the difficult decision of what action to take in order to help alleviate their growing debt.  Whether your debt is in the form of loans, credit cards, or unpaid bills, our attorneys can advise you on which type of bankruptcy is best for you to pursue.

The different types of bankruptcies for individuals are Chapter 7 and Chapter 13.  With Chapter 7 bankruptcy, individuals usually keep all of their assets, including their car, furniture, and public benefits, among others.  Using the Homestead statute, most Massachusetts debtors can keep their homes as well.

For individuals who qualify for declaring Chapter 13 bankruptcy, they do not have to lose their property.  Instead, the individual will set up a payment plan with bankruptcy court to pay off their debt in monthly installments over the course of three or more years.
